Of course, if a charter can’t operate a business model that its competitors can operate, it’s not a level playing field. But it should be remembered that this is the field of play that is assessed by the charter – agreeing to these conditions to approve its integration.

Charter’s petition claims that despite the ability of major broadband providers to cut off customers’ data, the streaming video business and its customers, which the merger rules were designed to protect, are “prospering.”

Instead, Charter says, “video consumers hold the upper hand and show an insatiable interest in the possibilities of video.” Of course, viewers are likely to be more interested in video content with or without data caps, so it’s hard to see the relevance of this claim.
